Creator Terms
Version 2026-10-19 · Effective October 19, 2026 · JGN MEDIA CORPORATION, doing business as Creator365Media
In plain words
- You are paid for conversions that are approved and not reversed. Approval takes the advertiser’s confirmation and our fraud checks.
- You must clearly say when a post is paid. Honest claims only; no fake traffic, incentives, spam or bidding on brand names.
- Changing where you are paid needs your password and pauses payouts for 48 hours, to protect you.
- We can pause or close an account that breaks the rules, and withhold earnings from invalid traffic.
This summary is a convenience. The full Terms below are what you agree to.
1. Who we are and what this covers
These Creator Terms (the "Terms") are the agreement between JGN MEDIA CORPORATION, doing business as Creator365Media ("Creator365", "we", "us"), a Florida corporation at 5794 Bird Rd, Unit #752, Miami, FL 33155, and the person who creates an account to promote offers through our network ("you", "Creator").
By creating an account, or by promoting any offer through us, you accept these Terms. Our Privacy Policy, the details of each offer you join ("Offer Terms"), and any written approval we give you also apply. If the Offer Terms for an offer are stricter than these Terms, the Offer Terms win for that offer, as long as they do not break the law.
2. Who can join
- You must be at least 18, able to enter a binding contract, and located in the United States.
- Tell us the truth about who you are: your legal name, any business name you operate under, your country, your contact details, and the social accounts you promote on. Keep them current.
- One person, one account. Do not share your login, and tell us straight away if you think someone else has accessed your account. You are responsible for what happens under your login.
- We review applications and can accept, decline, pause or remove any account, or any access to any offer, at our discretion, including if we cannot verify who you are.
- To help you, a member of our team or an account manager assigned to you may view your account and your performance. They cannot accept terms, change your payout details, or withdraw money on your behalf.
3. How the network works
- We give you tracking links for offers run by advertisers. When someone clicks your link and later completes the action the offer pays for (a "Conversion"), we record it and attribute it to you.
- Our tracking records are the basis for all attribution and payment, unless you show us a clear error.
- A Conversion is not payable the moment it is recorded. It starts as pending and becomes payable only when it is approved. Approval depends on the advertiser's confirmation and on our checks for invalid or fraudulent activity (see "Invalid and fraudulent activity").
- We do not guarantee any amount of traffic, conversions or earnings, or that any offer will stay available. Offers can be changed, capped, paused or ended at any time. A change applies to activity from the time it takes effect.
4. Commission and payment
- What you earn. The payout for each offer is shown to you before you take it. You are paid the commission for Conversions that are approved and not reversed. Where an offer has tiers or bonuses, its Offer Terms say how they work.
- Currency. Earnings stay in the currency the offer pays in. We do not add different currencies together or convert them for you.
- Minimum and method. You can withdraw once your approved balance in one currency reaches the minimum payout, currently $50. We pay by the methods shown in your dashboard. If a method is not shown, it is not available.
- Tax forms. Before we can pay you, you must give us a tax form we approve (for example a W-9 or W-8). We can withhold payment, and any tax the law requires, until we have it. You are responsible for your own taxes.
- Changing where you are paid. If you change your payout destination or currency, we ask for your password, email you about the change, and hold payouts for 48 hours. This protects you if someone else gets into your account. Do not ask our team to bypass it.
- Reversals. An approved Conversion can still be reversed if the advertiser reverses it (for example a refund, chargeback, cancellation or duplicate), or if we find it was invalid or breaks these Terms. Before payment we remove it from your balance. After payment, we may deduct it from your future earnings, and if there are none, you agree to repay it within 30 days of our written request.
- Holds. We may hold or delay a payment while we investigate suspicious activity or while a payout is in progress, and we will tell you why unless the law or an investigation stops us.
- Disputes about earnings. Tell us in writing within 30 days of the payout or statement you dispute. We will review in good faith and answer in writing.
- When the account closes. After closing, we will pay the approved, undisputed balance you are entitled to once any reversals and holds are settled and you have given us what we need to pay you. Earnings from invalid or prohibited activity are not paid.
5. Your content and how you promote
- Use only the creative materials we or the advertiser provide, or your own material that has been approved in writing before you publish it. Do not change approved material in a way that alters its meaning.
- Disclose that you are paid. You must clearly disclose every paid or sponsored relationship, in line with the FTC's Endorsement Guides and similar laws where you operate. Put the disclosure where it cannot be missed, in the same form as the endorsement (in the video and in its description if it is a video), in the same language, and in plain words such as "Ad", "Advertisement" or "Paid partnership". Do not rely on unclear tags such as "sp", "collab" or "ambassador" alone.
- Be truthful. Do not make claims you cannot support, hide important terms, or leave a false overall impression of an offer. Do not invent urgency, scarcity, prizes or approvals, and do not say or suggest that you are the advertiser or that we or you are affiliated with it.
- Follow the rules of every platform you use (YouTube, TikTok, Instagram, Meta, Google and others) and all laws that apply to your promotion, including privacy, consumer protection and email laws.
- Only promote where the offer allows: its permitted countries, audiences, channels and dates. Stop promoting when an offer ends, is paused, or reaches a cap.
- If you use email, send only to people who have asked to hear from you; identify the message as an ad; use accurate sender and subject lines; include a working way to opt out and your postal address; and honour opt-outs within 10 days.
- Keep a record of where and when you published each promotion, and give it to us within 2 business days if we ask.
The following are not allowed unless we approve them in writing in advance:
- paying, rewarding or otherwise incentivising people to click or convert, or running offers that make people "earn" something for doing so;
- spam, unsolicited bulk messages, or text-message (SMS) or telemarketing promotion;
- buying search keywords or domains that use an advertiser's or our trademarks, or sending traffic through misleading redirects, pop-unders, forced clicks, hidden or auto-loading frames or back-button traffic;
- using bots, scripts, fake accounts or any traffic that is not a real person's genuine choice;
- targeting or collecting information from anyone under 18;
- placing links on sites or in content that is unlawful, hateful, sexually explicit, deceptive, pirated or otherwise likely to harm us or an advertiser;
- generating Conversions for yourself, your household, or an account you control, unless the Offer Terms allow it;
- removing, altering or interfering with tracking links, pixels, tags or any other measurement we provide;
- recruiting others to promote through your account, or paying others to promote for you. If we approve it, you remain responsible for what they do.
6. Invalid and fraudulent activity
- Invalid activity means anything that is not a genuine person acting freely on honest information: bots, click farms, self-referrals, incentivised or misleading traffic, forged or manipulated data, duplicates, and activity that breaks the rules above.
- We monitor activity with our own and third-party tools. If we suspect invalid activity, we may hold or reject the related earnings, pause your links or account, and ask you to show where your traffic came from. We will work with you in good faith, but we make the final decision on whether activity is valid.
- Earnings from invalid or prohibited activity are not payable, and we may recover anything already paid for it.
- If you break these Terms we may suspend or close your account immediately, withhold earnings that relate to the breach, and tell advertisers and platforms where the law allows. You are responsible for losses and claims that your breach causes us or an advertiser.
7. Intellectual property
- Advertisers' names, marks and creative materials belong to them. We give you a limited, non-exclusive, revocable licence to use the materials we provide, unchanged, only to promote the offer they are for, while the offer is live.
- You keep ownership of your own content. You give us and the advertiser a non-exclusive, worldwide, royalty-free licence to display and share your promotional content for the campaign and for 12 months afterwards, and you confirm you have the rights to give it.
- You must not use our name or marks, or an advertiser's, except as we approve.
8. Your information and ours
- We handle your personal information as described in our Privacy Policy. Do not scrape, copy or misuse data from our platform, and do not try to identify or contact other creators or consumers from it.
- Keep confidential anything non-public you learn from us: payout rates, advertiser terms, tools, and other creators' or advertisers' information. This does not cover information that is public, or that you must disclose by law (tell us first where you can).
9. Our relationship
- You are an independent contractor, not our employee, partner or agent. You choose how and when you promote. You cannot sign anything or make promises for us or for an advertiser.
- Nothing here stops you working with others, unless an offer's terms say otherwise.
10. Ending this agreement
- You can close your account at any time by telling us in writing. We can end or suspend your account at any time, with notice where reasonable, and without notice if you break these Terms or put us, an advertiser or consumers at risk.
- When it ends, stop using our links and materials. Sections that by their nature should continue (payment and reversals, intellectual property, confidentiality, liability, indemnity and disputes) continue.
11. No guarantees
THE NETWORK, TRACKING, REPORTS AND ALL OFFERS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS WE GIVE NO WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED SERVICE, OR THAT TRACKING WILL BE ERROR-FREE.
12. Limits on liability
TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER OF US IS LIABLE TO THE OTHER FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, DATA OR BUSINESS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE AMOUNT WE PAID YOU IN THE SIX MONTHS BEFORE THE EVENT THAT GAVE RISE TO IT. THESE LIMITS DO NOT APPLY TO INDEMNITY OBLIGATIONS, TO YOUR OBLIGATION TO REPAY AMOUNTS UNDER "COMMISSION AND PAYMENT", OR WHERE THE LAW DOES NOT ALLOW THEM.
13. Indemnity
- You will defend and cover us, our officers, employees and advertisers against third-party claims, and the reasonable costs of dealing with them, that arise from your content or promotion, your breach of these Terms, or your breach of the law.
- We will defend and cover you against third-party claims that materials we supplied, used as allowed, infringe someone's intellectual property rights.
- The party seeking cover must tell the other promptly in writing and reasonably cooperate; the party giving cover controls the defence and cannot settle in a way that harms the other without consent.
14. Disputes and governing law
- If there is a problem, write to us at info@creator365media.com first. We will try to resolve it in good faith for 30 days.
- These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
- If a dispute is not resolved, it must be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to those courts' jurisdiction and venue. The prevailing party may recover reasonable legal costs where the law allows.
15. Changes to these Terms
We may update these Terms. We will tell you by email or in your dashboard and show the new version number. If a change is significant, we will ask you to accept it again before you continue to withdraw. You can close your account if you do not agree. We record which version you accepted, and when.
16. Electronic acceptance
When you tick the box or click to accept, you are signing electronically, and you agree this has the same effect as a handwritten signature. We record the time, the version of the Terms, and the network address and browser you accepted from.
17. General
- You may not transfer your rights or duties under these Terms without our written consent. We may transfer ours to a successor to our business.
- If part of these Terms cannot be enforced, the rest still applies.
- These Terms, the Privacy Policy and the Offer Terms are the whole agreement between us on this subject.
- We may notify you by email or in your dashboard. You can notify us at info@creator365media.com or 5794 Bird Rd, Unit #752, Miami, FL 33155.
- Not enforcing a right does not waive it.
